Below is 'copy and paste' ESS assassment that was completed for MUSIC's Advanced Performance Programme where highly skilled and sometimes famous performers come to talk about their experiences, demonstrate techniques etc. Their talk is not mandatory to attend and content is not part of any assessment.
If you are going to use this as an example for a different assessment please remember to answer all the questions in relation to your worker.
Any reasons as to why we have answered a question in a particular way we have highlighted in yellow.

Your answers
1. Which of these describes you best?
The end client
2. Has the worker already started this particular engagement for the end client?
No
3. How does the worker provide their services to the end client?
As a sole trader
4. Will the worker (or their business) perform office holder duties for the end client as part of
this engagement?
No
5. If the worker's business sent someone else to do the work (a substitute) and they met all
the necessary criteria, would the end client ever reject them?
Yes - the end client has the right to reject a substitute for any reason, including if it would negatively
impact the work
6. Can the end client move the worker to a different task than they originally agreed to do?
No - that would need to be arranged under a new contract or formal agreement
7. Once the worker starts the engagement, does the end client have the right to decide how
the work is done?
No - the worker decides how the work needs to be done without input from the end client
8. Can the end client decide the schedule of working hours?
No - the worker decides their own schedule
In our opinion the worker determines ‘what is done and when’ during their
demonstration/workshop. Any preparation would have been in their own time. The time will have
been mutually agreed with the worker’s availability being the driver.
9. Can the worker choose where they work?
No - the task determines the work location
